Pink Panther Power – Terms and Conditions 2024.1

Article 1 – Definitions

In these Terms and Conditions, the following capitalized words have the meanings stated below:

  • Supplementary Agreement: An agreement whereby the Customer acquires products, digital content, and/or services related to a remote agreement, and these items, digital content, and/or services are provided by Pink Panther Power or a third party based on an arrangement between the third party and Pink Panther Power.
  • Terms and Conditions: This set of terms and conditions applicable to the Agreement, outlining arrangements primarily concerning the relationship between Pink Panther Power and the Customer.
  • Cooling-Off Period: The period within which a Consumer may exercise their right of withdrawal.
  • Consumer(s): The Customer (a natural person) not acting in the course of a profession or business. If “Consumer” is used in these Terms and Conditions instead of “Customer,” it exclusively refers to Consumers.
  • Day(s): Calendar day(s).
  • Service(s): Services performed by Pink Panther Power.
  • Digital Content: Data produced and supplied in digital form.
  • Durable Medium: Any tool, including email, that allows the Customer or Pink Panther Power to store information addressed personally to them in a way that facilitates future reference or use for a period matching the purpose of the information, enabling unchanged reproduction.
  • Right of Withdrawal: The possibility for a Consumer to terminate a Remote Agreement within the Cooling-Off Period.
  • Customer: Any natural or legal person who purchases a Product.
  • Model Withdrawal Form: The European model form for withdrawal included in Annex I of these Terms and Conditions.
  • Agreement: Arrangements made between Pink Panther Power and the Customer concerning the Product and Service. The Terms and Conditions apply to this Agreement.
  • Remote Agreement: An agreement concluded between Pink Panther Power and a Customer within the context of an organized system for remote sales of products, digital content, and/or services, using one or more techniques for remote communication up to and including the conclusion of the agreement.
  • Product(s): Products sold by Pink Panther Power, such as natural supplements.
  • Written: Where “written” is mentioned in the Terms and Conditions, it explicitly includes “by email.”
  • Pink Panther Power: The counterparty to the Customer, as further defined in Article 2.

Article 3 – Applicability

  1. These Terms and Conditions apply to all offers made by Pink Panther Power and to every Agreement concluded between Pink Panther Power and the Customer.
  2. Before concluding a Remote Agreement, the text of these Terms and Conditions will be provided electronically in a manner allowing the Customer to store them easily on a Durable Medium. If electronic provision is not feasible, Customers will be informed where to access the Terms and Conditions electronically and that they can be sent free of charge upon request.
  3. Deviations from these Terms and Conditions are only valid if agreed upon in writing, with the remaining provisions still in force.
  4. All rights, indemnifications, and claims stipulated in these Terms and Conditions for the benefit of Pink Panther Power also apply to third parties, employees, and/or subcontractors (such as freelancers or contractors) engaged by Pink Panther Power.

Article 4 – The Offer

  1. Offers/quotations are valid for 14 days from the quotation date unless otherwise specified.
  2. The offer includes a complete and accurate description of the Products, Digital Content, and/or Services. Obvious errors in the offer do not bind Pink Panther Power.
  3. Offers specify details of the Products and Services, prices, estimated delivery times, and payment conditions.
  4. Pink Panther Power offers supplements made from natural herbs aimed at enhancing users’ libido. These Products are not substitutes for medical advice or treatment. Customers experiencing complaints before, during, or after use must consult their doctor.
  5. Results from using Products may vary by individual. Pink Panther Power does not guarantee specific results.

Article 5 – The Agreement

  1. The Agreement is concluded when the Customer accepts the offer or fulfills its conditions.
  2. Since the Agreement is concluded electronically, Pink Panther Power ensures appropriate technical and organizational measures to secure the electronic transfer of data and maintain a safe web environment.
  3. Price reductions after concluding the Agreement, such as promotions or discounts, do not entitle the Customer to a price reduction.

Article 6 – Pink Panther Power’s Obligations

  1. Pink Panther Power performs its Services/delivers Products properly and as agreed upon in the Agreement.
  2. Pink Panther Power adheres to the applicable legal requirements when delivering Products or performing Services.

Article 7 – Complaints

  1. Complaints about the execution of the Agreement or the Product must be submitted to Pink Panther Power in writing within 14 days after delivery. If the Customer does not complain within this period, the Agreement is considered executed as expected.
  2. Complaints must include detailed descriptions and, where applicable, photos to enable a proper response.
  3. Complaints are acknowledged within 14 days, with either a substantive response or an indication of when a more detailed reply will follow.
  4. The Customer must provide Pink Panther Power at least four weeks to resolve the complaint.

Article 9 – Delivery

  1. Delivery occurs at the address provided by the Customer.
  2. Orders are typically shipped within 24 hours of payment receipt (Monday–Friday). Weekend orders are processed the next business day.
  3. The indicated delivery time is an estimate. If no specific time is agreed upon, a maximum delivery period of 30 days applies to consumer purchases.

Article 10 – Transportation and Delivery

  1. Pink Panther Power bears the risk of damage and loss during transportation until delivery to the Customer or a designated representative, unless otherwise agreed.
  2. Visible damage upon delivery must be reported within three days.

Article 13 – Right of Withdrawal

  1. Consumers may withdraw from the Agreement within 14 days of receiving the Product.
  2. During the Cooling-Off Period, the Product must remain unopened and in original condition unless necessary to determine its nature or function. Opened packages cannot be returned.

Article 15 – Liability

  1. Pink Panther Power is liable for proven damages up to €2,500 if caused by demonstrable negligence.
  2. Pink Panther Power is not liable for indirect damages, such as lost profits or business delays.

Article 16 – Miscellaneous

  1. Dutch law applies to these Terms and Conditions and Agreements. Disputes are resolved by the competent court in Amsterdam, unless mandatory consumer law stipulates otherwise.
  2. The Vienna Sales Convention does not apply.

For European customers, rights provided under EU consumer protection laws remain fully applicable.
